These Terms of Service (“Terms”) govern your access to and use of the Carfluence websites, platform, APIs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1. Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for your account, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account.

2. Accounts & Eligibility

You must provide accurate information when creating an account and keep it up to date. You must be authorized to bind any organization on whose behalf you use the Services.

3. Customer Data

You retain all rights to the data you or your integrations submit to the Services (“Customer Data”). You grant Carfluence a limited license to host, process, and transmit Customer Data solely to provide and improve the Services. Our handling of personal data is described in our Privacy Policy.

4. Acceptable Use

You agree not to:

• Reverse engineer, disrupt, or attempt to gain unauthorized access to the Services;
• Use the Services to violate any law or infringe any third party’s rights;
• Upload malicious code or interfere with the integrity or performance of the Services; or
• Resell or provide the Services to third parties except as expressly permitted.

5. API & Rate Limits

Use of the Carfluence APIs is subject to the documentation and any rate limits we publish. We may modify, suspend, or discontinue API features with reasonable notice.

6. Fees

Paid features are billed according to the plan or order you select. Unless stated otherwise, fees are non-refundable. We may change pricing prospectively with notice.

7. Intellectual Property

The Services, including all software, content, and trademarks (excluding Customer Data), are owned by Carfluence or its licensors and are protected by intellectual property laws.

8. Disclaimers

The Services are provided “as is” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Carfluence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Services or other users.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date above and, where appropriate, communicated to you directly.
